It is commonly used when defects have been identified and you want to put the issue on a formal footing before the matter escalates further. That might be after practical completion, during a defects liability period, or while work is still being argued about on site. A proper letter can help set out what work is said to be defective, what rectification is being requested and why the other party is said to be responsible. It also creates a clearer record than scattered emails, texts or site conversations.
That depends on the project documents and the dispute history, but defect letters often need to deal with more than a list of faulty items. In some matters, the real argument is about whether the work was within scope, whether a variation changed the standard expected, whether access or safety issues affected the work, or whether payment disputes are being used as leverage. We can frame the letter around the defect complaint while also addressing those connected issues where they are relevant to the position being taken.
The service usually includes reviewing the information and project documents you provide, preparing a formal defect rectification letter, and making sure the letter states the complaint in a way that is clear and commercially usable. The letter can identify the defects, refer to the contract setting, request rectification and outline what may happen if the issue is not addressed. It is broader than a bare template letter, but it is not the same as acting for you throughout a full construction dispute or adjudication.
Sometimes a simple template is too blunt for a live construction issue. If the letter overstates the problem, ignores the contract wording or misses context around variations, access, timing or payment, it can weaken your position rather than strengthen it. Construction disputes often turn on project-specific detail, including what was agreed on site and what documents support that version of events. A lawyer-prepared letter is useful where the defects are contested, the dollar value matters, or the other side is already pushing back on responsibility.
A formal letter does not force the other party to act, but it can be an important step in setting out your position and preparing for whatever comes next. Depending on the situation, the next step may involve further correspondence, negotiation, expert input, mediation or a more formal dispute pathway. This service includes guidance on immediate next steps, but ongoing representation is not included in the fixed-fee. If the matter continues, we can discuss whether separate support is needed for the next stage.

They provide legal services working remotely from Australia via our 'legal consultancy' model, through which (under section 6 and section 35 of the New Zealand Lawyers and Conveyancers Act 2006) our Australian legal team are permitted to provide legal services to New Zealand businesses provided they do not provide services in certain 'reserved' areas of law. Given the strong similarities between Australian and New Zealand law, and the areas of law in which we practice (being small business and startup law), we do not view the fact that our lawyers have not qualified in New Zealand as having any substantive impact on the quality of our service.
