Frequently asked questions

Unsure about how we work? We have gathered the most common questions for your convenience.

Because a marketplace usually sits in the middle of several relationships at once. You may collect account details from buyers, business information from sellers, transaction records, reviews, messages, support requests and analytics data, then disclose parts of that information to payment providers, logistics partners or other users. A basic website policy often assumes a simple one-business-to-one-customer model, which does not describe a marketplace very well. If the document does not match how the platform actually operates, it may leave important disclosures unclear or incomplete.

That depends on the structure of the platform, but it often covers what personal information is collected, how users create accounts, what happens when buyers and sellers interact, when information is disclosed to service providers, how reviews or messaging tools work, and how access or correction requests are handled. Some marketplaces also need wording around merchant onboarding, fraud checks, support tickets or overseas software providers. The wording should reflect the information your business collects, the reasons it is used and the parties it is shared with, not just the label attached to the platform.

We usually need a practical overview of the platform model. That can include who the users are, what each side of the marketplace can see, what information is collected at sign-up, whether payments are processed through third parties, how messaging or reviews work, and what external tools sit behind the platform. We may also ask whether sellers receive buyer details directly, whether customer support is outsourced, and whether data is stored or accessed outside New Zealand. Those facts shape the document more than generic industry labels do.

Template wording often needs adjustment so it matches the actual transaction, workflow and risk allocation. However, marketplaces often outgrow generic wording quickly. Templates may not explain multi-party disclosures, platform messaging, seller dashboards, moderation tools, referral systems or integrated payment and fulfilment services. That can be a problem if users are trying to understand what happens to their information at different points in the transaction journey. A tailored policy is usually the better option where your platform has more than one user type or where information is shared across several service providers and platform functions.

No. This service covers the legal drafting of the privacy policy document and related advice on the wording. It does not include technical implementation, security remediation, regulator engagement, dispute representation or wider compliance management across your platform. If your marketplace also needs related documents or internal process advice, that may require separate work.

Scope note: requirements can vary depending on the platform model and third-party providers involved, and third-party decisions sit outside Sprintlaw's control.
