Unsure about how we work? We have gathered the most common questions for your convenience.
This retainer is usually a good fit for businesses that regularly collect, store or share personal information and want legal support available before an issue becomes urgent. That can include online businesses, software providers, marketing businesses, clinics and service providers handling customer, patient or staff data. It is especially useful where multiple systems, vendors or teams touch personal information, because the legal position often turns on what happened in practice, what information was involved and how your business normally handles it.
The difficulty is often not just the incident itself, but the follow-on decisions. Businesses may need to work out what information was affected, whether the event is likely to trigger notification concerns, what should be said to affected people, and how internal records should be kept. Problems also arise when public statements, customer emails and internal facts do not line up. This retainer gives you a lawyer to contact for those practical judgement calls, rather than relying on generic cyber or IT playbooks alone.
It usually includes an upfront privacy risk assessment discussion, priority access when an incident arises, legal input on notification questions, and help with incident-related communications such as customer notices or internal wording. It can also include broader privacy compliance support connected to incident readiness during the retainer period. The service is broader than a document-only job, but it is not unlimited outsourced counsel. Technical containment, forensic work, system fixes and security remediation sit outside the fixed-fee unless we agree that scope with you upfront.
Not in a full end-to-end sense. We can help you think through privacy law issues, review communications and assist with legal responses within the agreed scope, but ongoing representation or management of the whole incident response process is not included as standard. Your business may still need internal decision-makers, IT specialists, cyber providers or PR support depending on the event. If a matter becomes more complex, we can discuss separate support for additional legal work beyond the retainer.
No. A response plan is usually a document or framework that sets out steps, roles and escalation points before anything goes wrong. A retainer is ongoing access to legal support when real questions come up during the year. Many businesses use both. The plan helps your team respond consistently, while the retainer gives you legal input when facts are unclear, notification issues arise or communications need careful wording. If your processes change often, the retainer can be a practical complement to a static plan.
