A Privacy Policy is required by law if you collect the personal information of users. We also recommend having one in place even if you’re not required by law, as it is good practice to do so anyway. The Google algorithm update now includes TrustRank that scans your website privacy policy to generate a trust score. Not having an updated Privacy Policy can negatively impact your page ranking.

A Privacy Policy is a legal document which usually lives in the footer of a website, available to view by anyone who visits. You may also know these as privacy notices or privacy statements.

It’s basically a notice saying that you will respect their privacy, make sure their personal information is kept private, and their contact information is not misused. It allows you to remain transparent with your users or customers about how you’re collecting their information, how it is being stored and any third parties that it is being disclosed to.

Under the Privacy Act, there are certain requirements and wording that you must comply with.

All New Zealand websites should ideally have a Privacy Policy, however, it is compulsory to have one if you collect any type of personal information.

If you collect anything like their email, phone number, their home or work address, or payment information you should definitely have a Privacy Policy.

4. Ensure that you will not be “spamming”, selling or renting out the information that you collect. 
5. How someone who’s left their details with you can check the information and how they can unsubscribe from your email list.
6. How one may lodge a complaint about a breach of any Privacy Principles and how you would resolve such a complaint.
7. State if you disclose personal information to others (including organisations) and whether they are overseas.
8. How customers can contact you.
